How can we terminate a commercial lease?
Posted by: | CommentsWe try to open a new business, we found a perfect location and signed the lease about 7months ago. It’s a brand new building, still not finished. The projected delivery date was Dec 31, 2006 and the landlord keeps telling us that it is almost done! BUT IT’S NOT !!! He’s gonna need couple more months. So we decided to terminate the lease and find a new place.
What is the best way to do it? We want our deposit back. Does he have a right to charge us anything?

how much will my credit score go down if i turn in a commercial lease?
Posted by: | CommentsI have a small company that has a commercial lease on a $90,000 straight truck. The semi has not been on the road for over 6 months and I can’t afford the $1800 monthly payment. What happens if I turn the vehicle back in. Currently it is registered to the company but I am the personal guarantor on the note.

Exiting a commercial lease early will affect my real property how?
Posted by: | CommentsMy ex general partners want to close the business and exit the lease early. I am still on the lease with them. I have tried to get off of the lease, but the landlord won’t allow it because my partners have no assets, therefore they are a greater risk. I listed all of my assets on the lease agreement which us 3 partners personally signed. My main question is, can I lose my 2 condos over this. If yes, how? What happens? Can I claim bankruptcy? If I do, will I lose my condos, or will I be able to keep them. Will I need to hire a lawyer? How will I pay my lawyer, with what money?
The business is not making any money. The partners do not have money for next month’s rent…

I just sold my business and the new tenant took over. I was never in default of rent. The new tenant just signed a lease and their first payment is right after my last payment. No break in between. The landlord released me from my lease which had two years to go. But still holds security deposit.

I will allow the tenant to get out of his lease with me. I will allow him to leave under certain conditions, which are actually, in my opinion, very reasonable. I know some people have demanded that tenants pay them lump sums when getting out of a lease, but I am willing to forgo that.
Anyway, the tenant would like to have me sign a paper from his lawyer saying that I will end the lease under these conditions.
Should I do that?
OR- should I just say that I will sign nothing. And that I will declare the lease to be void after the conditions have been met?

Also, how likely is the owner of commerical property going to be willing to let one retailer share his space (possibly sublease) with another retailer for part of the year? I would like to open a retail store, but only want to have it open a few months out of the year and don’t want to have to pay for a whole year’s lease.
